1. Acceptance
These Terms of Service and Membership Agreement (“Terms”) govern your use of NJ Virtual Connection and your participation in its matchmaking services.
By creating an account, purchasing a membership, or otherwise using the service, you acknowledge that you have read, understood, and agreed to these Terms, the Privacy Policy, Refund & Cancellation Policy, Binding Arbitration Agreement, NJ Internet Dating Safety and No Criminal Background Screening Disclosure, Member Safety Rules, and applicable matchmaking disclosures and acknowledgments.
You must be at least 18 years old to use the service.
2. Matchmaking Service
NJ Virtual Connection provides a matchmaking service intended to help members identify potential compatible introductions.
The service may include review of member questionnaires, personal interviews, evaluation of compatibility information, identification of potential members, communication with members concerning potential introductions, and facilitating an introduction when appropriate.
NJ Virtual Connection does not guarantee:

Any particular number of matches or introductions;

That a member will receive an introduction;

That a proposed introduction will accept or respond;

That members will meet in person;
-
Compatibility;
-
A date, relationship, engagement, marriage, or other relationship outcome; or
-
That a member's preferences will always result in an available potential introduction.
3. Member Preferences
Members may provide personal information and preferences that NJ Virtual Connection may consider when evaluating compatibility.
Members may indicate the importance of particular preferences.
NJ Virtual Connection may consider whether a stated preference is important or not important when evaluating potential introductions.
NJ Virtual Connection may determine that an introduction is not appropriate where available information indicates insufficient compatibility.
No member is guaranteed an introduction based on any particular preference or questionnaire response.
4. Accuracy of Information
Members agree to provide information honestly and to update material information when reasonably necessary.
NJ Virtual Connection does not independently guarantee the accuracy, completeness, identity, character, intentions, background, relationship status, or other representations of any member.
5. Personal Interview
NJ Virtual Connection may require a personal telephone interview after enrollment, generally within the first month of membership.
The interview is not ordinarily audio-recorded. NJ Virtual Connection may retain written notes or information reasonably necessary to provide the matchmaking service.
6. Member-to-Member Introductions
NJ Virtual Connection will not intentionally provide one member's private contact information to another member without appropriate authorization.
When NJ Virtual Connection identifies a potential introduction, it may contact the members involved and seek their agreement before exchanging contact information.
Once members are introduced and choose to communicate directly, responsibility for their communications, interactions, meetings, relationships, and subsequent conduct belongs to the members themselves, subject to rights and responsibilities that cannot lawfully be waived.
7. Safety and Background Screening
NJ Virtual Connection does not conduct criminal background screenings on its members.
Members are responsible for exercising reasonable caution, independently evaluating information provided by another member, and following the Member Safety Rules.
NJ Virtual Connection does not represent or warrant that any member is safe, honest, truthful, compatible, free of criminal history, or suitable for another member.
8. Membership and Automatic Renewal
Membership is offered on a recurring monthly basis unless otherwise stated at checkout.
The applicable membership price and renewal terms will be disclosed before purchase.
By purchasing a recurring membership, you authorize the applicable payment provider to charge the applicable recurring membership fee according to the disclosed billing schedule until you cancel.
9. Cancellation
Members may cancel their membership using the cancellation method made available through their account or otherwise provided by NJ Virtual Connection.
Cancellation stops future recurring charges after the cancellation has been processed.
Cancellation does not automatically create a right to a refund for amounts already charged.
10. Refunds
Refunds are generally not provided except where required by law or where NJ Virtual Connection determines that a refund, credit, or other remedy is appropriate under the Refund & Cancellation Policy.
No refund is guaranteed merely because:

A member does not receive a match;

A proposed match declines;
-
A member is dissatisfied with a proposed introduction;

A relationship does not develop;
-
A member does not marry or enter a relationship; or
-
A member's preferences cannot be fully accommodated.
11. Member Conduct
Members must not use the service to:

Harass, threaten, stalk, intimidate, or abuse another person;

Commit fraud or impersonation;
-
Solicit money or financial assistance from another member;
-
Misuse another member's personal information;
-
Engage in unlawful conduct;
-
Misrepresent material information;
-
Circumvent the service for improper purposes; or
-
Violate applicable law or these Terms.
12. Suspension and Termination
NJ Virtual Connection may suspend or terminate membership for violations of these Terms, safety concerns, fraud, abuse, unlawful conduct, material misrepresentation, payment issues, security concerns, or other lawful business or safety reasons.
Nothing in this provision is intended to waive or restrict a member's non-waivable legal rights, including the right to communicate with governmental or regulatory authorities or exercise rights protected by law.
13. Member-to-Member Disputes
NJ Virtual Connection is not responsible for disputes between members arising from communications, dates, relationships, meetings, or other interactions after an introduction.
Members remain responsible for their own decisions and conduct.
14. No Professional Advice
NJ Virtual Connection is a matchmaking service and does not provide medical, psychological, legal, financial, or other professional advice.
15. Privacy
The collection and use of member information is governed by the NJ Virtual Connection Privacy Policy.
16. Electronic Communications
Members consent to receiving communications reasonably necessary to administer their membership and provide the service, including account, billing, interview, matchmaking, safety, and service-related communications.
Marketing communications are governed separately by the Communication & Marketing Consent.
17. Third-Party Services
NJ Virtual Connection may use third-party providers for website hosting, membership management, payment processing, communications, security, analytics, and other business functions.
18. Disclaimer of Warranties
To the maximum extent permitted by law, the service is provided without warranties except those that cannot lawfully be excluded.
NJ Virtual Connection does not warrant any particular matchmaking result, relationship outcome, accuracy of member-provided information, or safety of any member.
19. Limitation of Liability
To the maximum extent permitted by applicable law, NJ Virtual Connection shall not be liable for indirect, incidental, special, consequential, exemplary, or similar damages arising from use of the service.
To the maximum extent permitted by law, NJ Virtual Connection's aggregate liability arising from the service shall not exceed the greater of the amount the member paid to NJ Virtual Connection during the three months preceding the event giving rise to the claim or $100.
Nothing in these Terms excludes liability or rights that cannot legally be excluded or limited.
20. Indemnification
To the maximum extent permitted by law, a member agrees to defend, indemnify, and hold harmless NJVirtualConnection L.L.C., its owners, officers, employees, contractors, and agents from claims, losses, liabilities, damages, costs, and expenses arising from the member's unlawful conduct, violation of these Terms, or misuse of the service.
21. Dispute Resolution
Covered disputes are subject to the Binding Arbitration Agreement.
Before initiating arbitration, the parties will first have a reasonable opportunity to attempt to resolve the dispute informally and in good faith.
If the dispute cannot be resolved informally, it will proceed according to the Binding Arbitration Agreement unless an applicable exception applies.
22. Governing Law
These Terms shall be governed by applicable New Jersey law and applicable federal law, without regard to conflict-of-law principles, except where another law is legally required to apply.
23. Changes
NJ Virtual Connection may update these Terms from time to time. Material changes will be communicated in a manner reasonably designed to provide notice.
24. Severability
If any provision is determined to be unenforceable, the remaining provisions shall remain in effect to the extent permitted by law.
25. Entire Agreement
These Terms, together with the documents expressly incorporated into them, constitute the agreement between the member and NJ Virtual Connection concerning the service.
